Den åtalade hade i samband med notdragning emot ägarens förbud stigit i land på en villatomts strand, vilken av gammalt hade använts av delägarna i ett fiskelag såsom notdragningsplats. Han ansågs ha gjort sig skyldig till hemfridsbrott men meddelades domseftergift med stöd av SL 3 kap. 5 § 3 mom.
